But back in Washington, his Health and Human Services Department is launching a pilot program that would shift up to 2 million of the poorest and most-vulnerable seniors out of the federal Medicare program and into private health insurance plans overseen by the states.

Even though it’s been a few hours now, I’m guessing you’re still pinching yourself to make sure you’re not dreaming. But yes, it happened. At 10:07 this morning, the conservative Chief Justice of the U.S. Supreme Court, John Roberts, not only joined with the liberal justices to completely uphold almost every single part of the Obama health care law, he wrote the majority opinion himself! In fact, he went even further. When he realized that the government had poorly made its constitutional case to the court, he went searching for a clause in their argument and the Constitution that would give him the justification he needed to back the administration and to ensure that his decision would hold up legally. In other words, even though he is on the opposite side of the political fence, he wrote the Dems’ paper for them. Stunning.

Получается, Кеннеди был против, а вот Робертс оказался за, и стал решающим голосом? Очень много будет разных последствий у этого решения, и почти все эти последствия выглядят весьма неприятно.
Интересно, как это скажется на ноябрьских выборах. С одной стороны, это мощная победа Обамы, но с другой стороны противники закона, а их очень много, получают серьезнейшую дополнительную мотивацию – закон теперь можно убрать, только имея своего президента и достаточное большинство в обеих палатах. Любопытно может получиться.
UPD: Ромни набрал сотню тысяч менее чем за час после объявления решения.

A majority of doctors support measures to deny treatment to smokers and the obese, according to a survey that has sparked a row over the NHS’s growing use of “lifestyle rationing”.
Some 54% of doctors who took part said the NHS should have the right to withhold non-emergency treatment from patients who do not lose weight or stop smoking. Some medics believe unhealthy behaviour can make procedures less likely to work, and that the service is not obliged to devote scarce resources to them.

Отличный довод в пользу того, что правильное государственное здравоохранение гораздо лучше, чем все это американское безобразие со страховкой. Решит государство по какой-нибудь причине, что хрен тебе, а не лечение – и действительно, хрен тебе, а не лечение. Почему-то это все напомнило мне давешние разговоры про социал-дарвинизм. Главное, видимо, это правильно выбрать признаки, по которым должен происходить отбор.

Scott Rasmussen, известный поллстер, считает, что Obamacare не выживет в любом случае, даже если Верховный суд этот закон не убьет, и даже если республиканцы не смогут его отменить после выборов – просто потому, что такая реформа нереалистична экономически.
По-моему, это он оптимист. Мало ли что экономически невозможно, когда это кого останавливало.
А Обама, конечно, опять насмешил. Мешает ему Верховный суд ужасно. То есть даже либеральная пресса в некотором недоумении.

Penn, Shrum и Stephanopulos присоединились к Карвиллу, объясняя, что поражение Obamacare в Верховном Суде может обозначать победу для Обамы. Мол, Обама тогда сможет тыкать пальцем в республиканцев и говорить – видите, мы пытались, а они не дали.
Во-первых, он и так пальцем тычет неустанно весь срок, и победности ему это особо не прибавляет. Во-вторых, обвинять республиканцев в решении Верховного суда – занятие довольно глупое, это может подействовать только на некритичную базу. В общем, хилые доводы. Хоровые рассуждения в таком русле наводят на мысль о некоторой панике в этих рядах.
А вот два текста о причинах, по которым целая куча разных экспертов катастрофически недооценила потенциальные проблемы для Obamacare в Верховном суде. Один написал Greg Sargent, либеральный журналист, и он попросту полагает, что консервативный блок в Верховном суде оказался слишком консервативным для экспертов. Мол, они и предположить не могли, что Скалия опустится до того, что станет повторять аргументы Tea Party! Второй текст написал Jonathan Adler, и опубликован он на Volokh Conspiracy, это консервативный юридический блог, которому The Atlantic приписывает ключевую роль в развитии идеи о неконституционности Obamacare. Вот что Адлер там пишет:
Effective appellate attorneys are conscious of this problem and devote substantial energy trying to get inside the minds of their opponents. As I’ve heard Paul Clement (among others) explain, you can’t effectively advocate your own position until you truly understand the other side. This can be difficult to do, particularly when we have strong feelings about a subject. Someone who believes the PPACA is a long-overdue step toward remedying the profound injustices of the American health care system is not predisposed to embrace arguments that the PPACA is unconstitutional. And if those same academics both lack colleagues with opposing points of view and have no particular professional interest in making sure they fairly consider the other side, it is easy for them to overlook the strength of opposing arguments and reduce them to caricatures.
На мой взгляд, эта проблема для либералов носит универсальный характер. Это не только про юристов.

Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr. said they shared the view of Scalia and Kennedy that the law should stand or fall in total. Along with Justice Clarence Thomas, they would have a majority to strike down the entire statute as unconstitutional.

The Supreme Court just wrapped up the second day of oral arguments in the landmark case against President Obama’s healthcare overhaul, and reports from inside the courtroom indicate that the controversial law took quite a beating.
Today’s arguments focused around the central constitutional question of whether Congress has the power to force Americans to either pay for health insurance or pay a penalty.
According to CNN’s legal analyst Jeffrey Toobin, the arguments were “a train wreck for the Obama administration.”
“This law looks like it’s going to be struck down. I’m telling you, all of the predictions including mine that the justices would not have a problem with this law were wrong,” Toobin just said on CNN.
Toobin added that that the Obama administration’s lawyer, U.S. Solicitor General David Verrelli, was unprepared for the attacks against the individual mandate.
Как-то очень уж оптимистично это выглядит, тьфу-тьфу.
