Многие удивлялись – как это Обама, бывший преподаватель конституционного права, взял да и нагородил такую удивительную чушь про никем не избранных людей в Верховном суде, которые совершенно беспрецедентно собираются отменить демократически принятый Конгрессом закон. Мол, Обама должен все-таки знать и про Marbury v. Madison, и про то, что Верховный суд именно для того и существует, чтобы остальные ветви власти поправлять в случае чего, и про то, почему Верховных судей не выбирают. Как же это он вдруг такие глупости говорит?

И вот обнаружилась разгадка: обамин бывший студент сообщает нам, что Обама читал не Con Law I, где про разделение властей, Marbury v. Madison и прочие неудобные вещи, а Con Law III, где про Четырнадцатую поправку.

“Теперь все понятно”.

Сокращение “Con Law”, кстати, тоже красивое.

Вообще забавно наблюдать, какие корчи происходят сейчас с либералами из-за проблем Obamacare в Верховном суде. Верховному суду, конечно, не позавидуешь. Вечно они виноваты то перед либералами, то перед консерваторами. Особенно Кеннеди карму себе попортил, надо полагать. Вот бы в президенты человека с его взглядами, эх.

Заголовок на Huffington Post: The President’s Speech and the Ryan Budget: Two Very Alternative Visions

Интересный у них там подход все-таки. Бюджет Райана почему-то сравнивается не с бюджетом Обамы, а с его речью. Не оттого ли, что обамовский бюджет был в Палате провален единогласно – как республиканцами, так и демократами? Some vision indeed.

UPD: Ответ Райна на эту речь – “Desperate and demagogic is how I would describe his speech in two words.”

И действительно, так и выглядит. Обаму можно понять – тут тебе и Obamacare вот-вот накроется медным тазом, и бюджет завалили…

Побочный результат для Райана – усилились слухи, что Ромни может предложить ему вторую позицию в тикете.

MIAMI – Florida State Sen. Chris Smith, frustrated by what he calls “stalling” by Gov. Rick Scott following the shooting death of unarmed teen Trayvon Martin, is launching a task force to review the controversial law at the center of the case.

“Instead of waiting on the governor to act, I’ve decided to lead in the state of Florida,” the Fort Lauderdale Democrat said Tuesday. “I’ve assembled a task force to look at the controversial Stand Your Ground law.”

The governor created a task force to review Stand Your Ground two weeks ago, but has said the group will not convene until after the investigation into the Trayvon Martin shooting is completed.

In addition, the media has consistently described the laws incorrectly. The “Stand Your Ground” or “Castle Doctrine” laws replaced the original requirement to retreat with a “reasonable person” standard, that a reasonable person would believe that a criminal intends to inflict serious bodily harm or death. For example, you can’t shoot a fleeing criminal in the back. You can’t provoke the attacker into attacking. You can’t use unnecessary force to stop the attack. Anyone who thinks that the law lets them “shoot first, ask questions later” will end up jail.

The Washington Post’s description is almost laughable, claiming the law “immunizes an individual from criminal charges if he asserts he had a ‘reasonable’ fear of grave harm.” It isn’t that the individual firing the gun who gets to say that he had a “reasonable” fear.

Ultimately, a judge or jurors get to decide if the fear was reasonable.

The Wall Street Journal ran a story implying that the increase in justifiable homicides from 176 in 2000 to 326 in 2010 arose from a ‘shoot first’ mentality. But the article fails to acknowledge that the laws increased the number simply by changing what is classified as self-defense. The important issue here is whether the law increased total murders.

I have conducted the only published, refereed academic study on these laws, and I found that states adopting “Castle doctrine” laws reduced murder rates by 9 percent and overall violent crime by 8 percent.

“At that point Zimmerman is able to unholster his weapon and fire a shot, striking Trayvon in the chest. Trayvon falls on his back and says, ‘You got me.’”

Сосед Зиммермана, тоже бывший в свое время капитаном neighborhood watch, рассказал по телевизору, что у них там за последний год было восемь ограблений и одна неудавшаяся попытка, и виноваты во всех случаях “black young males”.

Проверка показала, что из восьми ограблений раскрыты три, и про четвертое есть подозрения (не у полиции, а у пострадавших). Про остальные четыре полиция ничего найти не смогла. В первых четырех фигурируют, совершенно верно, young black males.

И все в hoodie, небось.

Обама обозвал республиканскую версию бюджета “социальным дарвинизмом”. Это у него ругательство такое, оно вообще широко распространено в либеральной среде. В фильме In Time, который был выпущен на экраны одновременно с запуском движения Occupy Wall Street, главный негодяй хранит украденный у простого народа миллион лет в сейфе, пароль к которому – день рождения Дарвина.

Мне всегда было интересно, как получается яростно воевать с противниками теории эволюции, одновременно столь же пламенно ненавидя идею конкуренции в обществе. Что, не получается сообразить, к чему приведет уничтожение конкуренции вместе с соответствующей системой стимулов? примеров, может, мало?

The beating sparked outrage in the community but there were very few that stepped up to do anything about it. I would presume the inaction was because of the fact that he was homeless not because he was black. Do you know the individual who stepped up when no one else in the black community would? Do you know who spent tireless hours putting flyers on the cars of persons parked in the churches of the black community? Do you know who waited for the church-goers to get out of church so that he could hand them flyers in an attempt to organize the black community against this horrible miscarriage of justice? Do you know who helped organize the City Hall meeting on January 8, 2011 at Sanford City Hall?? That person was GEORGE ZIMMERMAN.”
